Rudy Martinez and his son Jerrel are both racists.

I hired Rudy Martinez and his company big bear electric to do the electrical work for a remodeling project I was contracted to complete.

I had used big bear electric in the past. big bear electric has done tens of thousands of dollars worth of work for me over the last 10 or so years.

Rudy Martinez sent his son Jerrel Martinez to my jobsite to perform the work that his father Rudy Martinez had contracted.

Jerrel Martinez came to my jobsite and it was obvious that he hadn’t had a shower in days. He was wearing a bottle of cologne to cover up his stench.

Jerrel Martinez is a morbidly obese human being.

Jerrel Martinez is an incredibly lazy electrician.

Jerrel Martinez did not complete the demolition of the existing electrical system that was required before installing a new system. The rough electrical wiring had been installed. I called his father Rudy Martinez and told him that his son had not completed the demolition. I was not certain if the junction box on the end of a long piece of wire laying on the floor was actually needing to be installed or not. It seemed to me that it was needing to be removed but it had not been done. There is also a second junction box that had not been removed in a different location.

It took three days for Jerrel Martinez to do the electrical demolition and the rough wiring.

Rudy Martinez had drawn up a contract that says that they would demo the existing system.

I called Rudy Martinez to ask him about this demolition that had not been completed. I needed to get the drywall installed. I have a schedule to complete this project. This is not part of that.

It took two days for Jerrel Martinez to come back to my jobsite only to tell me with an attitude that he didn’t have time to do the demolition and didn’t know when he would. This is a man that would show up at 10 o’clock in the morning to start work, take an hour lunch and then leave at 4 PM for the day.

This demolition took me one half hour of my time to complete as the junction boxes needed removing needed to be cut out with a saws all. I had to complete the work that I had contracted with Rudy Martinez and big bear electric to do.

This is a $10,000 contract for rough electrical installation that I have paid Rudy Martinez and big bear electric to complete this work. This is not a personal favor. This is a contract for electrical work. An incredibly expensive contract for electrical work.

When the time came in the progression of the remodeling project to have the electrician come back and install the finish electrical portion of electric system, Rudy Martinez sent his son Jerrel Martinez to complete the work.

I told Jerrel that there were some missing puck lights in the living room ceiling. Jerrel Martinez informed me that that was not a big deal because the wires could be easily run up through the empty cavity. I had talked about these lights with Rudy Martinez and they were supposed to be included with this project.

I spent some time that morning when Jerrel Martinez came to install the finish electrical portion of the electrical system to reiterate and explain what needed to be done in detail. We discussed exactly how I wanted the exterior conduit placed on top of the drywall that would contain the wiring for the electrical receptacles needed. We discussed exactly where the two can/puck lights in the hallway ceiling would go. These are completely straightforward discussions as I told Jerrel Martinez that the lighting needed to be centered in the ceiling and that the conduit and receptacle boxes needed to be straight and level across the wall.

I asked Jerrel Martinez how he was going to do the installation on the wall with the conduit. I asked him how he was going to get it straight and level. For some reason this made Jerrel Martinez angry and he started giving me an attitude and talking down to me like I was less than a human being.

I offered Jerrel Martinez some installation advice.

I relate to Jerrel Martinez that I am the person that is paying for this work to be completed. I want this work to be done correctly and done one time. I tell him how I would install the conduit to be able to get it straight and level. I tell him how the vertical portion of the conduit should run away from the edge of the wall up to the junction box for the light switch. I tell him not to get too close to the edge of the wall. Jerrel Martinez tells me, with this I’m talking down to you attitude, that’s where he wants to put the conduit. Right next to the edge of the corner of a wall. I tell Jerrel Martinez that this is not how I want it done because it is going to ruin the drywall.

 I am not at all happy with being talked down to by some morbidly obese kid in his 20s. In 21 years in business as a construction contractor I have never been treated like this or talk to like this by anyone let alone somebody I hired to do work for me.

I tell Jerrel Martinez that I am not at all happy with his attitude and that I want this job done right one time and that I don’t want to have to do it over again.

The finish trim portion of this contracted work was approximately $4000.

For $4000 I should not have to stand there and watch Jerrel Martinez do his work as he is supposed to be a licensed electrician.

This particular day I was setting tile in the adjoining condominium. When I was at a point of completion for my workday, I came into the area that the finish portion of the electrical work was being completed. It had been a very long day. Jerrel Martinez and his helper were apparently just finishing up and getting ready to leave the condo. I was happy to see that the work had been completed. I thanked them and they left.

I had been setting to tile in a very small shower for hours. I was very tired. I did not look at Jerrel Martinez work closely right away.

After a short while I did go to look at the work and could see that the conduit was not at all level. This is completely unacceptable.

The vertical conduit that I specifically told him to not put next to the edge of the corner of the wall was mounted at the edge of the corner of the wall using strapping brackets that required two screws one on each side of the conduit. Installing this strapping bracket in this manner destroyed the drywall. This type of conduit would only require one single attachment in side of the metal electrical conduit.

This is completely unacceptable.

This is a $1.4 million condominium. The installation of the conduit looked like an amateur did it.

I send Rudy Martinez a text telling him that the conduit his son installed was wonky and needed his attention.

I didn’t get any response so I called him and told him that he needed to come and look at this thing.

It wasn’t until a little later that I realized that the can/puck light in the hallway ceiling was installed incorrectly. It was three quarters of an inch off of center.

This is completely unacceptable.

When I spend the time to tell somebody exactly how something needs to be done and they do exactly what you tell them not to do, this isn’t a mistake.

I also noticed that the three can/puck lights in the living room looks ceiling were not installed.

I’m upset by the whole thing. I have worked months on this project to get to this point in time. And here I have the finish electrical work done by an amateur electrician. Yes, an amateur electrician, Yes someone that wanted to fuck my project up.

When Rudy Martinez did finally show up to my jobsite to look at the problems he was extremely angry. I showed him the problems that his son Jerrel Martinez caused. He became even more angry at me and started telling me how bad my work was.

in 21 years as a construction contractor I have never experienced something like this.

I am not yelling at Rudy Martinez about his son’s crappy work. I have no idea why Rudy Martinez is so angry.

This is in no way any kind of normal reaction to a professional problem on a construction site.

Rudy Martinez is furiously angry with me because I told him his son hadn’t had a shower in days and showed up to my jobsite smelling like a bottle of cologne that you could smell a block away.

A normal reaction would be hey, I’m sorry about this will get it taken care of, don’t worry.

Reaction I get from Rudy Martinez is in no way a normal reaction.

There was no contrition here because there was no mistake done here. This was done on purpose.

Yes, I was worried I needed to get this project completed by 20 November.

Rudy Martinez shows up days later with his helper to fix his son Jerrel Martinez unacceptable installation. Rudy Martinez is absurdly angry when he arrives to my jobsite to do this work.

I tell Rudy Martinez that there is an electrical breaker in the electrical breaker panel that will not stay on. It is a electrical breaker that controls the ceiling lights in the hallway using two separate switches on the wall, one at each end of the hall. I also tell Rudy Martinez that there is something wrong with the switches in the hallway that run the ceiling can/puck lights.

Rudy Martinez and his helper install the electrical conduit on the walls and move the can/puck light in the hallway ceiling to its proper installation location. By doing this it leaves a large gap in the drywall. Rudy Martinez tells me he is not going to fix the drywall in the ceiling as he is not responsible for any drywall repairs.

Rudy Martinez is responsible for his improper unprofessional installation.

Rudy Martinez calls for a final electrical inspection. Rudy Martinez does not tell me when the final electrical inspection is going to be. I send Rudy Martinez text to ask him when the inspection is going to be and I get a vague two day window. I text Rudy Martinez the day of the final electrical inspection asking him when he is going to show up with an electrical inspection not knowing that he has the electrical inspection scheduled for that morning. I get no answer from Rudy Martinez telling me what time they are going to be doing an electrical inspection or even if he’s coming at all.

Rudy Martinez and Town of Vail inspector John Boggs show up to my jobsite to do a final electrical inspection.

I need to have this project done by November 20, 2020.

Mr. John Boggs seems to want to congratulate Rudy Martinez on his son Jerrel Martinez great job that he did on working on my project. Rudy Martinez says not a word to me as they enter the condominium.

Mr. John Boggs doesn’t seem to really want to do a electrical inspection. It seems he is under the belief that Jerrel Martinez is a fantastic A+ license electrician and he doesn’t have to check his work because he’s probably checked his work a lot in the past and hasn’t found anything wrong. So, he doesn’t check much of anything and is talking to Rudy about hunting and a new law in Colorado that was passed allowing wolves to be re-habitat it.

Mr. John Boggs doesn’t see a giant gap in the ceiling next to the can/puck light. Maybe he sees it and doesn’t care. I would think that is going to fail the electrical inspection with an installation like that. Maybe not. Mr. Boggs doesn’t check the light switches on the wall see if there working properly.

I am not pointing any flaw out to Mr. John Boggs as it is not in my client’s best interest for Rudy Martinez and big bear electric to fail this electrical inspection. It will push back the final inspection. It is clear that Rudy Martinez and big bear electric are not working for me the client. Rudy Martinez is treating me as I am less than a human being.

John Boggs passes the inspection. Rudy Martinez leaves.

I send Rudy Martinez an email telling him that his installation was unacceptable and that there are problems with the light switches. I tell him that if he does not fix this immediately I will call the town of Vail inspector and turn him into the state board of contractor licensing.

Rudy Martinez shows up on November 18 with his helper and fixes the problem with the light switches in the hallway and installs three can/puck lights in the switch. Rudy is absurdly angry and belligerent. He makes a gigantic mess and is stomping and throwing shit all over my brand-new hardwood floors. He tells me I need to pay him immediately right there on the spot for whatever his final invoice is. I ask for the invoice and he says he has to create it first. And that will be in my email.

I inform Rudy Martinez that I do not have my checkbook and that I am not going to pay him that day. I told him I would send him a check.

Rudy Martinez shows up the next day with his fists clenched yelling give me my money or I’m going to kill you. I tell Rudy that I don’t have my checkbook and I’m not paying him. I tell him I have 30 days to pay him.

Rudy Martinez tells me he’s going to kick my ass if I don’t pay him right there on the spot. I tell Rudy Martinez that he is trespassing. I tell him I’m going to call the police.

I call 911 and I get the operator on the phone.

Rudy Martinez takes off his glasses and says I’m going to kick your ass I’ll even let you have the first shot.

This is all on speakerphone on the 911 recording that is taking place. You can hear on the recording as he comes at me. I’m telling him he’s going to stay away or I’m going to protect myself.

The Vail police do finally show up and they arrest Rudy Martinez for trespassing.

I asked the police if he is going to be charged with assault. The police officer told me they were going to review the evidence and see if there were more charges to be brought.

The Police officer took my statement and told me somebody would be contacting me before they would be having any kind of court proceedings so they could talk to me about the case.

I don’t get any kind of call from the prosecutor’s department or town attorney or whoever might be in charge of reviewing a victim’s evidence in a violent crime.

I called the Vail Municipal Court on multiple occasions to ask about the court date. No one is answering the phone at the Vail Municipal Court. I was able to leave a phone message. Nobody returned my phone messages.

I decided I would go down to the Vail municipal building on January 18, the day before the scheduled pretrial hearing for this case. When I arrived at the Vail Municipal Court window in the municipal building. I was told by a Ms. Linda Moore that I was not going to be able to attend the pretrial hearing.

I asked if I could speak with the prosecutor. I was told no.

I asked for the prosecutor’s contact information and was told I could not have it. I was told that I was not able to get a phone number or an email for the town prosecutor.

I was told if I wanted to write something that Ms. Linda Moore would make sure that the prosecutor got to see it. That is apparently how the chain of custody works for evidence at the Municipal Court in Vail. I told Ms. Linda Moore that I would like to speak with the prosecutor and that she should have her call me.

I have not received any calls from the prosecutor.

I called the Municipal Court in Vail on January 20, the day after the pretrial hearing that I was refused entry to. I spoke with Linda Moore to find out the disposition of the hearing and the status of the case. I was refused.

Linda Moore did not tell me the disposition of the hearing and she did not give me anything in writing regarding the disposition of the hearing or the status of the case.

I sent Ms. Linda Moore an email requesting documents. I did not have any response.

I have called the Eagle County district attorney and was told by the secretary that answers the phone that Vail was not in their jurisdiction.

Vail is in Eagle County.

I’ve had several attempts to call the Eagle County district attorney and have not had my calls returned.

I file records requests to get the police departments documentation of the arrest. I was able to obtain a copy of the 911 call I made to the police. I was also able to obtain police body camera footage.. Along with a police report.

I was stunned to find out they treated an arrested criminal like he was their best friend.

Rudy Martinez was arrested for trespassing.

This is a criminal offense that you get handcuffed thrown in the squad car, hauled to the police station, fingerprinted, booked, and thrown in a jail cell for.

Rudy Martinez was not handcuffed.

Rudy Martinez was not searched.

Rudy Martinez was allowed to lounge leaning on his work truck seat with the truck door open drinking coffee while he is being arrested.

Rudy Martinez was asked if he had any weapons on his person.

Rudy Martinez replied yes. I have a knife. He then proceeds to pull an obviously dangerous large switchblade hunting knife out of his pocket to give to the police officer.

You can see this in the officer Deeling video at exactly 20 minutes and 2 seconds into the video.

Instead of the police officer taking a large dangerous knife from the person he’s arresting, he tells Rudy Martinez to put the knife in his truck.

This knife is nowhere in the police report but it is plainly visible in the video and it is clear that this is a knife and it is clear that Rudy Martinez acknowledged that he is holding a weapon on his person.

After being refused by the Vail Municipal Court, same as Linda Moore, I file a records request with the Vail Police Department asking for the hearing dispensation.

I get a call on January 27 from Vail police officer. He tells me he was told by the Municipal Court, same as Linda Moore, that he needed to call me for some reason. In the phone conversation he tells me he has no clue why he’s calling me. I asked him for the prosecutor’s name and contact information and was told the prosecutor’s name was Inga Causey but he gave me the phone number for the Vail Municipal Court which brings you to a electronic answering service that does not have any prompt to reach Ms. Inga Causey or to leave her a message.

The Pretrial hearing that was scheduled for this case on January 19 is a public hearing.

There is absolutely no reason why that this hearing should be secret.

There is absolutely no reason why the dispensation of the hearing would be kept secret.

There is absolutely no reason why I, labeled as the victim in the police report, shouldn’t be able to know the outcome of the case.

This appears to be some type of cover-up.

It appears that the Vail Police Department is a criminal gang.

It appears that the woman running the Vail municipal court is some type of gangster.

It appears that Judge Buck Allen would be the head gangster in the criminal conspiracy that is the Vail Police Department.

It appears that the Town of Vail and its police department are not accountable to anybody.

Civil Protection Farce

This is what the exchange would look like had Rudy Martinez actually gotten to see or speak with a police officer and ask him for a civil standby.

Rudy Martinez: officer I need your help with a civil standby.

Officer: Please tell me why you need a civil standby.

Rudy Martinez: officer I did some work for this guy and I haven’t been paid yet. I finished the project yesterday and I told this guy I want a check and he didn’t pay me yesterday when I finished my job. I told this guy I was going to come by today and get a check. I think I will have problems getting paid by this guy. So, I want you to be there.

Ofc.: so you want me to be there while you serve him with an invoice?

Rudy Martinez: Uh, I don’t have an invoice. I sent him an email with an invoice.

Ofc.: so you want me to be there while you send him an email. And ask him to pay you money?

Rudy Martinez: yes

Ofc.: have you done work for this contractor in the past? How long have you known him?

Rudy Martinez: yes I’ve done work for this guy in the past I’ve known him for several years.

Ofc.: a lot of work? A little work? What kind of money are we talking about?

Rudy Martinez: I’ve done tens of thousands of dollars worth of business with this guy.

Ofc.: so you done work for this guy in the past?

Rudy Martinez: yes

Ofc.: has he paid you for your work in the past?

Rudy Martinez: yes

officer: have you completed all of your work that you contracted to do with this contractor?

Rudy Martinez: yes

Ofc.: do you have any tools or materials left on his job site?

Rudy Martinez: no

Ofc. Mr. Martinez what you are asking me to do is inappropriate. If this person owes you money you should send him an invoice. If he doesn’t pay you, you can take him to civil court as this is a civil matter and is not a criminal matter.

If you have completed all the work you are contracted to do and you have no materials or tools on the job site. You have no business being at the property.

I’m going to advise you Mr. Martinez that you stay away from the job site.

How else would it have gone?

Oh sure Rudy, hop in the squad car and we’ll drive over there together so you can stand at the doorway and safely yell at him that you sent an email invoice yesterday and you want to get paid today. Let’s go.

Rudy Martinez knew that he was coming to my jobsite to start a fight. This is his pea brain attempt to cast himself in some kind of Boy Scout role.

This is Rudy Martinez talking; See how good I am I went to the police did station to get a civil standby. I did not get a civil standby. At least I tried.

This shows that Rudy Martinez was actually planning to come to my jobsite and harass and menace me. He is trying to give himself some kind of alibi “oh I’m a Boy Scout.”

Rudy Martinez did not try to get a civil standby.

Rudy Martinez did go to the police station and picked up a phone. Rudy Martinez could’ve called the police to set up a civil standby at any point in the day prior to this incident.

Rudy Martinez could’ve called the police while he was standing at the front door of the police station.

Rudy Martinez did go on that day to be arrested for trespassing.

Instead of actually talking to the police officer Rudy Martinez came to my jobsite and threatened to kill me. He takes off his glasses puts them on the railing and starts coming towards me. You can hear this on the 911 call. I'll even give you the first shot he says.

This is Rudy Martinez telling me I can have the first shot while he has a large dangerous switch blade knife in his pocket.

The 911 call is approximately eight minutes. I called them almost immediately as he arrived to the residence demanding money.

I was able to get a Permanent Restraining Order issued against Rudy Martinez by Judge Shamish in Lake County.

The Vail Municipal Court held it's hearing on this matter in secret, Violating my civil rights.

The Vail Police Department and Vail Municipal Court are a criminal gang.
