COLORADO VICTIMS’ RIGHTS LAWS1 Constitution Article II, Section 16a – Rights of Crime Victims Any person who is a victim of a criminal act, or such person's designee, legal guardian, or surviving immediate family members if such person is deceased, shall have the right to be heard when relevant, informed, and present at all critical stages of the criminal justice process. The Vail Municipal Court has changed the case # for this case from 2020-001372 to 2020-025393 to keep it secret.


I stopped at the Vail municipal court today. I thought I'd give it one more try before I publish this website.


I was pleasantly to surprised to not find Linda Schindel Moore working at the Vail Municipal Court window. Instead I found a Ms. Debbie Duran.


Ms. Duran obviously did not get the memo of she shouldn't be giving me any information.


Ms. Duran infoms me that the case has been adjudicated and Rudy Martinez was given a suspended sentence on a trespass charge and charged $160 fine.


I asked Ms. Duran why no one had contacted me before the pretrial hearing as I am the victim in this incident. She said she didn't know.


I asked her if that was normal to not contact the victim of a crime before sentencing. She said no.


The Pretrial hearing that was scheduled for this case on January 19 is a public hearing.


There is absolutely no reason why that this hearing should be secret.


There is absolutely no reason why the dispensation of the hearing would be kept secret.


There is absolutely no reason why I, labeled as the victim in the police report, shouldn’t be able to know the outcome of the case.


This appears to be some type of cover-up.


It appears that the Vail Police Department is a criminal gang.


It appears that the woman running the Vail municipal court, Linda Schindel Moore,  is some type of gangster.


It appears that Judge Buck Allen would be the head gangster in the criminal conspiracy that is the Vail Police Department.


It appears that the Town of Vail and its police department are not accountable to anybody.


Rudy Martinez Gets Arrested for Trespassing Possessing a Deadly Weapon. Vail Police Cover It up.


I talk with the Eagle County District Attorney office and was told Vail is not in their jurisdiction.


Officer Jose Balderas deliberately falsified the Police report by omitting the fact that Rudy Martinez was in possesion of a deadly weapon while committing a crime.


The following are the charges applicable to this incident;


Offense Against Persons

 

CRS 18-3-206 Menacing. A person commits the criminal violation of menacing if, by any threat or physical action, that person knowingly places or attempts to place another person in fear of imminent serious bodily injury.


Offense Against Propoerty

CRS Sec. 18-4-503 Trespass.(1) A person commits the crime of second degree criminal trespass if such person:

(b) Knowingly and unlawfully enters or remains in or upon the common areas of a hotel, motel, condominium, or apartment building;


CRS Section 18-9-111 - Harassment - Kiana Arellano's law

(1) A person commits harassment if, with intent to harass, annoy, or alarm another person, he or she:
6.Repeatedly taunting the victim in a way likely to provoke an unlawful response (“fighting words”).4

CO Rev Stats 18-1-901 (n) "Public place" means a place to which the public or a substantial number of the public has access, and includes but is not limited to highways, transportation facilities, schools, places of amusement, parks, playgrounds, and the common areas of public and private buildings and facilities.
